19 June, 2020
The American Bar Association in collaboration with the ABA International Law Section Cross-Border Real Estate Committee organize next Tuesday, June 30th, 2020 the Webinar Program “Leases in Times of COVID-19: Force Majeure, Regulatory Challenges and Market Realities” at 10:00am Eastern Daylight Time.
COVID-19 is re-shaping businesses in many ways. One of the most evident areas of impact has been the use and need for office and commercial space. Landlords are facing lease renegotiations or terminations by tenants, based on force majeure and similar arguments. During our webinar, we will explore these very current topics from the perspective of multiple jurisdictions (Mexico, Spain, US and Costa Rica) with varying legal systems, including:
- Lease clauses.
- General legal provisions that may apply in absence of contact language.
- Impossibility, impracticability and frustration of purpose in commercial leases.
- Effects on payment of rent.
- Renegotiation of leases.
- Landlord remedies.
- Effects of force majeure on other lease related obligations (construction, improvements, etc.).
