Berenice Sagaón is Partner in the Technology, Media and Telecommunications (TMT) and Compliance areas at ECIJA Mexico. She has more than 10 years of experience in privacy and personal data protection, anti-corruption, consumer protection and advertising, money laundering prevention and compliance programs. She stands out for her experience in the information technology (IT), financial and Fintech, entertainment, and cryptocurrency industries. She is recognized by The Best Lawyers Mexico 2023 in the category of Information Technology Law and Corporate Governance and Compliance.
Berenice has advised a large number of national and international clients, especially North American, European and Asian multinationals, on privacy and compliance matters. Likewise, she has specialized in the handling and follow-up of proceedings before different administrative authorities, including the stages of conciliation, investigation, verification, sanction, and nullity. She has led multiple projects of electronic payment processors, their relationship with the Institution of Financial Technology and Electronic Commerce, as well as consumer protection, privacy and inherent data to the operations of the sector.
Regarding her experience in contract law, her practice focuses on structuring and drafting agreements to document civil, commercial and consumer relationships, negotiating the terms and conditions thereof to balance and protect the interests of clients, as well as developing strategies for the prevention or resolution of conflicts.
Her experience in administrative matters has focused on consulting on regulatory compliance applicable to the promotion and marketing of various goods and services. She has collaborated in the drafting and registration of numerous contracts of adhesion, mainly for the provision of telecommunications services, leasing, real estate maintenance services, transportation and logistics, among others. She has also made legal analysis and recommendations on product labeling and advertising.
Regarding labor matters, she has assisted in the design and implementation of compliance programs for the prevention of occupational risks, including protocols on equality and non-discrimination, and labor violence.
Berenice studied law at Universidad La Salle, ULSA in Mexico. She is co-author of the article “La sobreventa de boletos y su impacto en los derechos del consumidor”, published by the Supreme Court of Justice and the Mexican Bar Association, and of the Data Privacy column of Industria Legal Magazine in Mexico. In addition, she is co-author of numerous publications, including “Fintech Series In Mexico: regulation to an innovation ecosystem” (ECIJA, 2022), Fintech Sector LATAM, (ECIJA, 2021) and “Metaverse Series in México” (ECIJA, 2022). She is a regular contributor to the media Lexlatin and Foro Jurídico, among others.
She is currently specializing in the Master’s Degree in Anti-Corruption offered by the Universidad Panamericana and is in the process of being certified in the ISO37001 Anti-Bribery Management System.
Last, she actively participates in conferences and seminars organized by the Mexican Bar Association (“BMA”) in her practice areas.
