Legal memo on the new Royal Decree 176/2023 on Safer Gambling Environments
Today, the expected Royal Decree 176/2023, regulating the development of safer gaming environments (“RD of Safe Gambling ” or “RDSG”) was published in the Spanish Official State Gazette (“BOE”).
This matter, commonly called “Responsible Gambling“, was regulated by Law 13/2011, of May 27, on the regulation of gambling (the “Spanish Gambling Law” or “SGL”) in articles 8, 10, 21 and 40 and developed by means of the RD 958/2020, of November 3rd, on commercial communications of gambling activities (Title II, arts. 29 to 35) (“RD 958/2020”). With respect to the foregoing, the new RD on Safe Gaming consolidates the enforceability and material scope of the currently applicable framework and entails new obligations for operators.
Based on the final text, we shall now proceed to analyse the entry into force of such obligations and the novelties of the RDSG.
