What happens now?                                                         

As it is well known, Brexit is already a reality. We are currently in the final stretch of the transitional period, which will end on the 31st of December, and from this date the United Kingdom will become a non-EU state, so only the treaties signed with the EU will be taken into account and not the EU treaties themselves. In this sense, all people who want to live or continue to live in an EU member state like Spain, will have to carry out different procedures to ensure that they obtain a residence permit.

What can I do to obtain a Residence Permit if I already have a European Union Citizen Registration Certificate?

Those who already had a European Union Citizen Registration Certificate before the 6th of July 2020 can exchange it for the new document until the 31st of December 2020 at a National Police station in their province of residence by providing the following documents:

  • The application form (model EX-23), duly completed and signed by the interested party or his/her legal representative
  • A valid and current passport of the applicant.
  • The Proof of payment of the fee of Model 790 Code 012 of the Ministry of the Interior.
  • A photograph (DNI-like)
  • A Current certificate or census form in case you have changed your address. (From the last three months, original and copy).
  • The Certificate of Registration as a Union Citizen or a Foreigner’s Identity Card if available. If not, report of loss or theft.

What happens if I didn’t obtain the European Union Citizen Registration Certificate before the 6th of July of 2020?

Those who didn’t obtain the Certificate of Registration of Citizenship of the European Union before the 6th of July, must make the procedures before an Office of Foreigners providing the following documents:

  • The application form (Model EX20), duly completed and signed by the interested party or his/her legal representative.
  • A valid and current passport of the applicant.
  • The documentation accrediting the commencement of residence in Spain. Any means of proof recognized by law (registration) must be accepted.
  • The proof of means of subsistence; this may be the Work Life File and/or Registration of being self-employed with the Social Security and Form 036 signed, if the citizen works, or the Private Medical Insurance and Bank Certificate if he/she doesn’t work.
