In 2022, we saw a number of high-profile collapses in the industry (FTX, Voyager, Three Arrows, Terra, Genesis).  Regulators already had crypto assets firmly in their sights and these high-profile collapses have only heighted the call for more government intervention.  The consensus appears to be to regulate rather than eliminate, but the various regulatory approaches are distinct.  In early 2023, US regulators significantly ramped up enforcement activities to new levels, adopting an explicit “regulation by enforcement approach” against the biggest players in the market.  Enforcement action in some other jurisdictions, by contrast, have been relatively modest perhaps to attract digital assets, which remain perhaps surprisingly resilient and attractive to investors, into existing financial services regime.  These differences in approach perhaps highlight the challenges of an industry that the markets are in many ways still struggling to understand but that shows few signs of disappearing.

What is the Global Conference?

Each year, NYSBA’s International Section hosts a conference in a different city outside of the United States to provide American and foreign colleagues the opportunity to meet, network, and expand their international practices. Our most recent conferences have been held in London (2022), New York City (2022), Tokyo, (2019), Montréal (2018), Antigua, Guatemala (2017), Paris (2016), São Paulo (2015), Vienna (2014), Hanoi (2013), Lisbon (2012), Panama (2011), and Sydney (2010).

This year, the conference will consist of three days of Continuing Legal Education (CLE) panels and plenaries on various hot topics in international law. The meeting also offers networking opportunities in the form of extended breaks, luncheons, receptions, dinners, including our traditional gala dinner, and social and cultural events.
