Carlos del Razo participates in a roundtable published by the magazine “Factor Energético”

On March 29, Carlos del Razo, senior partner in the Sustainability and Environment practice at ECIJA Mexico, participated in the discussion panel “Implications of the Energy Reform on International Commitments” within the forum “Energy Reform: What to Do and What Not to Do with International Commitments.”

During his presentation, Carlos highlighted the new sustainability mandate of the state-owned utilities, CFE and PEMEX, in light of Mexico’s international commitments. He also analyzed the challenges of reconciling the allocation of Clean Energy Certificates (CELs) to pre-2014 power plants within the framework of the new energy transition mandate and binding energy planning posed by recent reforms.

He also highlighted the risks Mexico faces in the area of ​​investment arbitration, depending on the way the new electricity market rules are implemented, considering that similar reforms in Italy and Spain led to Numerous awards against the courts for substantial compensation following energy reforms in those jurisdictions.

Finally, Del Razo emphasized the importance of establishing clear rules for companies’ transition to new regulatory frameworks, the proper management of social and environmental impacts, and monitoring of secondary regulation. The panel was moderated by Professor Fátima Jiménez and included the participation of Professor Maciel Salazar and Professor Héctor Garza.
